Terms and conditions for participation in the Formtastic Partner Program
Disclaimer: This is a translation of the original German version. In case of any discrepancy, the German version shall prevail.
1. Subject of the Agreement
The Partner shall promote formtastic.de products using the provided marketing materials or individual recommendations. A contract between the Partner and formtastic is established upon confirmation of the registration by formtastic.
2. Commission Model (Lifetime Participation)

Rate: The Partner receives a revenue share of 10% on the net license fees of the available plans.

Duration: Commissions are paid on a recurring basis (Lifetime) for as long as the referred customer maintains an active, paid subscription.

Guarantee: The entitlement to commission for a referred customer remains valid even if the Partner does not refer any additional new customers (true lifetime participation).
3. Commission Claims & Payouts

Tracking: The assignment is made via a browser cookie with a duration of 30 days. As soon as a referred user registers for a free formtastic account within this period, they are permanently assigned to the partner account.

Validation: A commission claim arises once the payment from the referred customer has been successfully received and the statutory cancellation period has expired.

Payout: Commissions are paid out once a minimum balance of €50.00 is reached. Balances below this threshold will be carried forward and paid out in the following month once the threshold is met.
4. Prohibited Practices
To protect the integrity of the formtastic brand, the following actions will lead to immediate termination and forfeiture of any outstanding commissions:
- Self-Referrals: Commissions are not paid on subscriptions for the Partner’s own company or affiliated companies.
- Brand Bidding: Running search engine advertisements (e.g., Google Ads) on the brand name “formtastic” or any similar variations.
- Spam & Misrepresentation: Unsolicited mass marketing (spam) or promising terms and conditions that do not align with official formtastic pricing.
5. Termination & Data Protection
Both parties may terminate the partnership at any time. In the event of an ordinary termination by the Partner, existing commission claims for previously referred customers remain unaffected, provided that a valid payout method (bank details/email) is maintained.
